These terms govern the websites and online services of Songs To Your Eyes Ltd, 655 Mallard Ct., Arnold MD 21012 USA ("Songs To Your Eyes", "STYE", "we", "us"), including the catalogue and player pages at mcp.songstoyoureyes.com and the licensing service (together, the "Site"). By using the Site you agree to them. Use of any music is governed by the separate Music Licence Agreement, Personal Listening Terms or Creator Subscription Terms; to the extent of any conflict, those agreements prevail for the music they cover. You represent that you are over 18 and able to accept these terms, and if you act for an entity, that you are authorised to bind it.
The Site and all content on it — the music catalogue, previews, metadata, text, design and branding — are owned by STYE or its licensors and protected by copyright, trademark and other intellectual-property laws. All rights not expressly granted are reserved.
Audio previews on the Site are watermarked evaluation copies. You may stream and download them solely to evaluate music for licensing. You may not use previews in any production, publish them, remove or attempt to remove the watermark, or represent a preview as licensed material.
You may not scrape, bulk-download, index for third-party services, or redistribute the Site or its content. You may not use any part of the Site or its content — previews and metadata included — for training, fine-tuning or evaluating any machine-learning or artificial-intelligence model, or include them in any dataset for such purposes. This right is reserved absolutely and licensed only under a separate written agreement. (AI assistants querying our published catalogue connector to help a person find music are welcome; harvesting the catalogue is not.)
The licensing service requires an account with a valid email address. Keep your credentials secure; you are responsible for activity under your account; one account per person; notify us immediately of unauthorized use. We may suspend accounts used in breach of these terms.
Purchases are processed by Stripe. All amounts are payable in full before delivery of licences or files. Your payment method's issuer may charge you foreign-transaction or similar fees. By purchasing you agree to Stripe's applicable service terms, and you authorise us to share the information needed to process your payment.

CATALOGUE DESCRIPTIONS (GENRES, TAGS, DURATIONS) ARE PROVIDED FOR CONVENIENCE AND THEIR ACCURACY IS NOT GUARANTEED.
TO THE FULLEST EXTENT PERMITTED BY LAW, STYE AND ITS DIRECTORS, EMPLOYEES AND AGENTS ARE NOT LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES ARISING FROM USE OF THE SITE, AND STYE'S AGGREGATE LIABILITY ARISING FROM USE OF THE SITE SHALL NOT EXCEED THE AMOUNTS YOU PAID US, IF ANY, IN THE TWELVE MONTHS PRECEDING THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW OR AFFECTS CONSUMERS' STATUTORY RIGHTS. Liability in connection with LICENSED music is governed by the applicable licence agreement, not this section.
You agree to indemnify and hold STYE harmless against claims, damages, costs and expenses (including reasonable attorneys' fees) arising out of your breach of these terms, your unauthorized use of the Site or its content, or your violation of another party's rights.
Any dispute relating in any way to your use of the Site or its content shall be submitted to confidential arbitration in Baltimore County, Maryland before a single arbitrator under the rules then prevailing of the American Arbitration Association, and the arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction — except that, to the extent you have violated or threatened to violate STYE's intellectual-property rights, STYE may seek injunctive or other appropriate relief in any state or federal court in the State of Maryland, and you consent to exclusive jurisdiction and venue in such courts. These terms are governed by the internal laws of the State of Maryland. To the fullest extent permitted by applicable law, no arbitration shall be joined to an arbitration involving any other party, whether through class arbitration or otherwise. Where applicable consumer law does not permit mandatory arbitration, disputes are instead resolved in the Maryland courts named above.
We may update these terms by posting the revised version with a new "last updated" date; continued use after posting is acceptance. We may suspend or terminate access for breach. If any clause is unenforceable the rest remain in effect; waivers are effective only in writing.
